Purposes of Processing

a) The data are collected for the following purposes:
Performance of obligations arising from a contract to which you are a party or to fulfill, prior to the execution of the contract, your specific requests;
b) Compliance with legal obligations, regulations, and EU legislation;
c) Customer management (customer administration, contract management, orders and invoices; verification of reliability and solvency);
d) Management of disputes (contractual breaches, formal notices, settlements, debt recovery, arbitrations, legal proceedings);
e) Direct Marketing purposes: personal data will be processed for sending commercial, promotional and advertising communications relating to products, services, events or initiatives of the Controller, by automated means of contact (email);
f) Sending informational communications, updates on the Controller’s activities, articles, guides and sector-related informative content (newsletter);
g) Preparation of quotations.

The legal basis for processing is:
• Contractual or pre-contractual necessity;
• Legal obligations to which the company is subject;
• Legitimate interest, such as the enforcement of legal claims including debt collection through out-of-court procedures; prevention of fraud, abuse of office, money laundering; physical security, etc.;
• The data subject’s consent, collected through a specific form, for the purposes referred to in letters e) and f).

Categories of Personal Data Processed

Identifying personal data such as first name, last name, company name, tax code, address, telephone, fax, email, identity document details (e.g., driver’s license/ID card/passport number), IBAN, and bank and/or payment details.

Source of the data:
The personal data in our possession are collected directly from customers. Data may also be collected from third parties, such as other customers or suppliers.

Recipients or Categories of Recipients

• Postal services or other mail delivery companies;
• Banks and credit institutions;
• Debt collection agencies;
• Law firms;
• Insurance companies;
• IT equipment maintenance/repair companies;
• Professional firms and/or companies and/or business associations providing accounting and/or tax services;
• Database, Cloud, or software application service providers;
• Certification bodies;
• Public authorities;
• Supervisory and control authorities.

These parties may act, in some cases, as independent Data Controllers and, in other cases, as Data Processors appointed by the Controller pursuant to Article 28 GDPR.
Your personal data may also be accessible to employees or collaborators of the Controller who are authorized to process data.
Your data will not be disclosed. Updated information about data recipients may be requested at info@accelerat.eu.

Your personal data will not be transferred to non-EU countries.

Additional Information to Ensure Fair and Transparent Processing

Data Retention Period

• Prospective customers: pre-contractual processing aimed at drafting contracts or commercial offers will be retained for 24 months;
• Customers: data will be retained for the entire duration of the contractual relationship and/or performance of requested activities and, after termination, for the period required by applicable accounting, tax, civil and procedural laws, and in any case no longer than 10 years from the last record; longer retention may apply in case of disputes until their resolution;
• Direct marketing purposes: data will be retained until consent is withdrawn and in any case no longer than 24 months from the date consent was given;
• Newsletter: data will be retained for the duration of the subscription until consent is withdrawn. Upon cancellation or withdrawal, data will be promptly deleted.

Rights of the Data Subject (Articles 15–21 GDPR)

You may exercise the following rights:
• Right of access (Art. 15 GDPR);
• Right to rectification;
• Right to erasure (right to be forgotten);
• Right to restriction of processing;
• Right to data portability;
• Right to object;
• Right to withdraw consent at any time;

Nature of Data Provision

The provision of personal data is optional. However, failure to provide data, partially or totally, may result in the partial or total impossibility of establishing or continuing the relationship where such data are necessary for its execution.

Your data may also be used to send advertising material and invitations to events organized by the Controller. Since this processing is based on your consent (Art. 6(1)(a) or Art. 9(2)(a) GDPR), you may withdraw your consent at any time without affecting the lawfulness of processing based on consent before its withdrawal.

Methods of Processing

Personal data are processed through operations such as collection, recording, organization, storage, consultation, processing, modification, selection, extraction, comparison, use, interconnection, blocking, communication, deletion, and destruction.

Data are collected through forms (paper or digital), contractual documents, or by telephone during pre-contractual activities. Processing is carried out both manually (paper format) and through electronic, IT, and telematic tools. Data are stored in electronic and paper archives and protected to minimize the risk of destruction, loss, unauthorized access, or unlawful processing.

Data are processed by employees or equivalent personnel duly instructed by the Controller.
